Any attorney fees, court costs or other costs incurred in collecting delinquent undisputed amounts shall be your responsibility. No contract will exist between you and Chowstik until Chowstik accepts your order by confirmatory email, SMS/MMS message or other appropriate communication.

You must send any Notice of Dispute via email to info@chowstik.com. Chowstik will send any Notice of Dispute to you by mail to your address if we have it, or otherwise to your email address.

You and Chowstik will attempt to resolve any dispute through informal negotiation within sixty days from the date the Notice of Dispute is sent. After sixty days, either party may commence arbitration.

If a dispute is not resolved by informal negotiation, any other effort to resolve it will be conducted exclusively by binding arbitration. You give up the right to litigate or participate as a party or class member in court before a judge or jury.

The dispute shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Either party may seek interim or preliminary injunctive relief from any court of competent jurisdiction as necessary to protect rights or property pending arbitration.

If you submit or post ideas, creative suggestions, designs, photographs, information, advertisements, data or proposals, including ideas for new or improved products, services, features, technologies or promotions, you agree such submissions are non-confidential, non-proprietary and become the sole property of Chowstik without compensation or credit to you.

Chowstik and its affiliates may use ideas contained in submissions or posts for any purpose and in any medium in perpetuity, including developing, manufacturing and marketing products and services using such ideas.

Chowstik may include contests, promotions, sweepstakes or other activities that require you to submit material or information. Promotions may be governed by separate rules with eligibility requirements such as age or geographic location.

Additional terms and conditions may apply to purchases of goods or services through the Services and are made part of this Agreement by reference.

If a product or service is listed at an incorrect price or with incorrect information due to typographical error, we may refuse or cancel orders placed for it. If your payment has already been charged and your order is cancelled, we will issue a credit to your payment account in the amount charged.

These Terms & Conditions, including the Chowstik Privacy Policy, contain the entire understanding between you and Chowstik concerning the subject matter and cannot be changed or modified by you. Section headings are for convenience only and have no legal import.

Chowstik is not responsible for any content, code or other imprecision. Chowstik does not provide warranties or guarantees.

In no event shall Chowstik be liable for special, direct, indirect, consequential or incidental damages, or any damages whatsoever, arising out of or in connection with use of the Service or its contents. Chowstik may make additions, deletions or modifications to Service contents at any time without prior notice.
